MYFINVAULT - ADVISOR PRIVACY POLICY
This policy explains data handling responsibilities, consent expectations, platform limitations, and legal boundaries for advisors using MyFinVault.
1. Platform Role
MyFinVault is a technology platform that enables advisors to manage, organize, and track customer-related financial and insurance data.
MyFinVault:
- Does not act as an insurer, broker, intermediary, or financial advisor
- Does not verify the accuracy, authenticity, completeness, or source of any data uploaded
- Does not provide any financial, insurance, or investment advice
- Acts solely as a facilitator for data storage, organization, and controlled access
All data made available on the platform is based solely on user or advisor input.
2. Advisor Responsibility & Declaration
By accessing or using the platform, the Advisor expressly confirms and undertakes that:
- All data uploaded has been collected through lawful means
- The Advisor has the necessary authority and rights to handle, store, and process such data
- Explicit and informed consent has been obtained from customers prior to uploading or sharing their data
- The data uploaded does not violate any applicable laws or third-party rights
The Advisor shall be solely responsible for:
- Accuracy, completeness, and authenticity of all uploaded data
- Lawful collection, storage, and use of customer information
- Compliance with all applicable legal and regulatory requirements
MyFinVault relies entirely on the declarations made by the Advisor and shall not be required to independently verify such consent or authorization.
3. Data Usage & Classification
Data stored on the platform may exist in the following forms:
(a) Private Advisor Data
- Data stored and maintained by the Advisor for internal use
- Not visible or accessible to the customer
- Managed entirely under the Advisor's control and responsibility
(b) Shared Customer Data
- Data that the Advisor chooses to share with the customer through the platform
- May be subject to customer approval, acceptance, or rejection (where applicable)
- Once shared and accepted, the customer may have rights to access, view, and manage such data
Important Clarification
- Sharing of data with customers is voluntary and controlled by the Advisor
- MyFinVault does not initiate or enforce data sharing
- Any dispute arising from shared or unshared data remains solely between the Advisor and the customer
4. Limitation of Liability
MyFinVault shall not be held liable for:
- Any incorrect, incomplete, or misleading data uploaded by the Advisor
- Any disputes between the Advisor and the customer, nominee, or any third party
- Any loss, damage, or claim arising out of reliance on the data stored on the platform
- Any unauthorized use of data caused due to the Advisor's actions or negligence
MyFinVault acts solely as a technology platform and shall not assume any fiduciary responsibility or legal obligation in relation to the data stored or shared.
5. Data Security & Usage Limitation
MyFinVault implements reasonable security measures to protect data; however:
- No system can guarantee absolute security
- Users are responsible for maintaining the confidentiality of their login credentials
MyFinVault shall collect and use data only for the purpose of providing its services and in accordance with applicable laws.
6. Suspension & Termination
MyFinVault reserves the right to suspend or terminate access to the platform in case of:
- Violation of these terms
- Misuse of the platform
- Any unlawful or suspicious activity
Such action may be taken without prior notice where necessary.
7. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of India.
The courts at Ludhiana, Punjab shall have exclusive jurisdiction over any disputes, claims, or matters arising out of or in connection with the use of the MyFinVault platform.
